TERMS & CONDITIONS
1. Rental Agreement
387 Rent a Car d.o.o. ("we", "us", "our") agrees to rent the vehicle specified on the first page of this agreement ("the Vehicle") to the customer ("you", "your") for the period and under the conditions set forth in this rental agreement.
2. Acceptance of Terms
By signing this Agreement, you accept and agree to abide by these general conditions.
3. Prohibition of Subletting
You are not permitted to rent the Vehicle to a third party or authorize anyone else to use the Vehicle under this agreement.
4. Authorized Drivers
Only you and any additional drivers specified in the agreement are authorized to operate the Vehicle. All authorized drivers must meet the eligibility criteria outlined in this Agreement.
5. Vehicle Use Terms
5.1 Permitted Use
You agree to use the Vehicle solely for personal transportation and not for any commercial purposes unless explicitly authorized in this Agreement.
5.2 Prohibited Uses
You will violate this Agreement if you or any person you allow to possess or operate the Vehicle:
- Use the Vehicle to carry passengers or property for hire.
- Use the Vehicle to tow or push anything.
- Operate the Vehicle while under the influence of alcohol or any other substance that prohibits safe driving.
- Use the Vehicle in connection with any conduct that could be charged as a felony, misdemeanor, or reckless driving.
- Transport hazardous materials.
- Participate in any test, race, or contest.
- Operate the Vehicle on unpaved roads or in a reckless manner.
- Transport more passengers than allowed by traffic regulations.
- Transport animals or any items other than personal luggage.
5.3 Responsibility for Prohibited Use
If you use the Vehicle for any of the above prohibited purposes, you will be held responsible for any resulting damage and must compensate 387 Rent a Car d.o.o.
6. Return of Vehicle
6.1 When to Return
You must return the Vehicle by the contracted date and time or earlier upon request by 387 Rent a Car d.o.o. Extensions are subject to Vehicle availability and must be approved at least 24 hours before the scheduled return time.
6.2 Where to Return
You must return the Vehicle to the designated return location specified in this Agreement. If you wish to return the Vehicle to a different location, you must obtain prior approval from 387 Rent a Car d.o.o. Failure to do so may result in additional charges.
6.3 Condition Upon Return
You must return the Vehicle in the same condition as when you received it, including all equipment and relevant documents (e.g., vehicle identification papers, CDW policy, and green card). In case of:
7. Fuel Policy
Return the Vehicle with the same fuel level as at pickup. If returned with a lower fuel level, you must pay the fuel difference plus a €10 fuel service charge.
8. Cleanliness
Return the Vehicle clean both inside and out. If not, a €15 cleaning fee will be charged.
9. No Smoking or Alcohol
Smoking or consuming alcohol in the Vehicle is prohibited. Violations will incur a €150 cleaning fee and may result in additional penalties for non-compliance with general conditions.
10. Geographical Restrictions
You are not allowed to drive the Vehicle outside of the permitted rental area without prior approval from 387 Rent a Car d.o.o. Unauthorized travel outside the permitted area will result in a €400 fine for violating this agreement.
11. Payment and Fines
11.1 Credit Card Requirements
The credit card must be in the name of the main or additional driver.
11.2 Fines and Penalties
You are responsible for any parking fines or penalties incurred during the rental period. These charges, along with any administrative fees, will be passed on to you.
11.3 Late Returns
If the Vehicle is returned later than agreed, an extra day charge will apply.
11.4 Extra Options
Additional options (e.g., GPS, baby seats, snow chains) are available upon request and subject to availability and seasonal variations.
11.5 Accidents and Incidents
In case of an accident, contact the police immediately, report the incident, and submit a copy of the police report along with the rental agreement to the rental location.
11.6 CDW Coverage
CDW protection does not apply beyond the agreed rental period. For detailed information about CDW, please check upon Vehicle collection.
11.7 Exclusions
Charges for damages to specific parts (e.g., antenna, car lock, keys, windshield wipers, interior, etc.) will be charged directly to you. CDW does not cover towing costs, telephone, taxi, or hotel expenses.
11.8 Responsibility
You are responsible for damages caused by negligence, intentional acts, or driving under the influence. Theft Protection (TP) is included in CDW but does not cover damages from theft attempts. Refer to the CDW policy for detailed exclusions.
12. Collision Damage Waiver (CDW)
12.1 CDW Options
387 Rent a Car d.o.o. offers three Collision Damage Waiver (CDW) options to suit your needs:
12.1.1 Premium CDW
Financial Responsibility: €0.00
Conditions: Applicable only if a police report is filed in the event of an accident.
Coverage: Full coverage with no out-of-pocket expenses for damage or theft, provided all conditions are met.
12.1.2 Standard CDW
Financial Responsibility: Partial responsibility as indicated in the pricing table below.
Conditions: Deductibles vary based on vehicle category.
Coverage: Reduces your financial liability for damage or theft up to the deductible amount specified for your vehicle category.
12.1.3 No CDW
Financial Responsibility: Full liability for all damage and theft up to the full value of the rental Vehicle plus administrative fees.
Conditions: Your personal insurance or credit card may not fully cover this rental.
Coverage: You are solely responsible for all damages and theft-related costs without any CDW protection.
12.2 CDW Pricing
The deductible amounts for Standard CDW vary based on the vehicle category:

Deductible amounts are subject to change based on vehicle availability and specific rental agreements.
12.3 Choosing CDW Options
At the time of rental, you must select one of the CDW options. Your choice will be reflected in the rental agreement and pricing.
Premium CDW is recommended for maximum protection with no financial responsibility, provided a police report is filed when necessary.
Standard CDW offers a balance between coverage and cost, reducing your liability with a manageable deductible.
No CDW is suitable for those who prefer to rely on their personal insurance or credit card coverage but carries the highest financial responsibility.
12.4 Acceptance of CDW Terms
By selecting a CDW option, you agree to the terms and conditions associated with that option. Failure to comply with these terms may result in forfeiture of CDW benefits and increased financial liability.
13. Reporting Issues
You must inform 387 Rent a Car d.o.o. immediately of any operational problems with the Vehicle, including warning lights on the dashboard. Failure to report may result in you being held responsible for related damages and repair costs.
14. Liability for Damage
You are responsible for all damages caused by inappropriate use or manipulation of the Vehicle and must cover the full repair costs.
15. Off-Road Driving and Ferry Use
15.1 Off-Road Driving
Driving the Vehicle off-road is prohibited. Violations will result in forfeiture of your deposit and responsibility for all resulting damages, including towing and rental unavailability costs.
15.2 Ferry Use
Using ferries with the Vehicle is prohibited. Violations will result in forfeiture of your deposit or a €400 charge for non-compliance with general terms and conditions.
16. Accuracy of Personal Information
You are liable for all Vehicle damages if you provide false or invalid personal data (e.g., passport, driving license, address). You are also responsible for any damages caused to third parties under these circumstances.
17. Traffic Accidents
In the event of a traffic accident, you must:
- Record the names, addresses, and telephone numbers of all drivers involved.
- Note the registration plates and CDW policy numbers of the involved Vehicles.
- Gather witness information, if any.
- Secure or move the Vehicle to a safe location before leaving.
- Inform 387 Rent a Car d.o.o. and follow their instructions.
- Call the police to file an accident report.
Failure to comply may result in you being liable for all damages incurred by 387 Rent a Car d.o.o.
18. Reporting New Damage
If any new damage (e.g., scratches, dents) occurs during the rental period, you must obtain a police report. This is essential for the validity of CDW, Super Collision Damage Waiver (SCDW), premium coverage, or any type of coverage. Without a police report, you will be charged for the new damage according to the damage matrix.
19. Arbitration
Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration association. Both parties waive the right to a jury trial.
20. Miscellaneous
20.1 Changes or Amendments
No changes may be made to this Agreement except in writing and signed by our authorized representative. We reserve the right to change these Terms & Conditions at any time by posting the changes on our website. Such changes will govern all rentals commencing after posting.
20.2 Severability
If any provision of this Agreement is held invalid, the remaining provisions will remain in full force and effect.
20.3 Definitions
"Agreement" refers to these Terms & Conditions and any other documents associated with your rental.
"Authorized Driver" means any person authorized to drive the Vehicle as specified in this Agreement.
"Designated Return Location" means the location identified in your Agreement for returning the Vehicle.
"Designated Return Time" means the date and time specified in your Agreement for returning the Vehicle.
"CDW" means Collision Damage Waiver, a coverage option that reduces your financial responsibility for damage to the Vehicle.
"Vehicle" means the car rented to you, including all equipment and accessories provided.
